The list of all contents or services made available through The Dressupper is the exclusive property of The Dressupper and is protected by Italian and international copyright and database rights.
Extracting and/or systematically reusing parts of The Dressupper’s Services without the express written consent of The Dressupper is prohibited. Specifically, you may not use data mining, robots, or similar devices for capture or extraction to extract (once or multiple times) or reuse any substantial part of any The Dressupper’s Service, without our express written consent. You cannot create and/or publish a database reproducing substantial parts (e.g. prices and product listings) of The Dressupper’s Services without the express written consent of The Dressupper.
4. TRADEMARKS                
The graphics, logos, page headers, button icons, characters and service marks of The Dressupper included or available through any of the The Dressupper’s Services are marks or trademarks of The Dressupper. Trademarks and marks of The Dressupper cannot be used in connection with products or services that are not provided by The Dressupper, so as to create confusion among customers, or in any other way that may disparage or discredit The Dressupper. Any other trademarks not owned by The Dressupper appearing in any of the The Dressupper’s Services are property of their respective owners, who may or may not be connected, related to or sponsored by The Dressupper.

The The Dressupper’s Services and functionalities available through these services are property of The Dressupper. The The Dressupper’s Services may use, in whole or in part, one or more patents under licenses.
6. LICENSE AND ACCESS
Provided that you comply with these General Terms of Use and the Terms of Service, and that you have paid any applicable fees, The Dressupper or its contents providers will grant you a limited, non-exclusive, non-transferable and non sub-licensable license to access the The Dressupper’s Services and make a personal and not commercial use of it. This license does not include any resale or commercial use of any The Dressupper’s Services, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any The Dressupper’s Service or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.. All rights not expressly granted by these General Terms of Use or the Terms of Service are reserved and retained by The Dressupper or its licensors, suppliers, publishers, owners or other service providers.
No The Dressuper’s Service, nor any part of any The Dressupper’s Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose in whole or in part without our express written consent. You may not frame or utilize framing techniques to enclose any trademark, logo or other proprietary information (including images, text, page settings, or form) of The Dressupper without the express written consent. You may not use any meta tags or any other “hidden text” using the name or trademarks of The Dressupper without the express written consent from us. You must not misuse the The Dressupper’s Services. You may use the The Dressupper’s Services exclusively only as permitted by law. The violation of these General Terms of Use or of the Terms of Service will result in the revocation of the authorization or license granted by The Dressupper.
7. YOUR ACCOUNT
If you use any of The Dressupper’s Services, you are responsible for maintaining the confidentiality of your account and your personal access details, and for restricting access to your computer; you also agree, to the extent permitted by applicable law, to be held responsible for all activities that occur under your account and your personal access details. You agree to take all necessary measures to ensure that your personal access information remains secure and confidential, and you agree to notify us immediately if you have reason to believe that any third party got to know your personal access information, or in case your personal access information is, or is likely to be, used in an unauthorized manner. You are required to make sure the information you provide is correct and complete and to inform us immediately of any change in the information you provided. You can see, review and change most of your personal information by logging into the section of the site dedicated to your personal account.
Generally, we will not manually modify your personal information because it is very difficult to verify your identity remotely. You may not use the The Dressupper’s Services : (i) in such a way as to cause, or may cause, interruption, malfunctioning or damages to The Dressupper’s Services and their functionalities, or (ii) for fraudulent purposes, or, in any case, to commit illegal activities or (iii) to create trouble, damage or concern.
We reserve the right to deny access to the Site and/or The Dressupper’s Services, to suspend or terminate an account, remove or edit the contents of the site at our sole discretion, in the event of a violation of applicable laws, the present General Terms of Use or the applicable guidelines and policies.
8. REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

If you choose to submit content or materials, and unless we indicate otherwise specified, you grant: (a) The Dressupper a non-exclusive, free, perpetual, irrevocable, sub-licensable and transferable to third parties right to use, reproduce, modify, adapt, publish, translate , create derivative works from, distribute and display such content throughout the world in any media and (b) The Dressupper, its sub-licensees and assigns, the right to use, in their sole discretion, the name that you submit in connection with such content. Your moral rights of authorships are excluded. You agree that these rights granted to us are irrevocable for the duration of your intellectual property rights associated with such content and materials. You agree to take all further acts necessary to finalize any of the above rights granted by you to The Dressupper, including the execution of deeds and documents, at our request.
You represent and warrant that you, personally or in any other way, that you own or otherwise control all of the rights to the content that you post; and that, on the date that the content or material is published: (i) the content and material are accurate and relevant; and (ii) the use of the content and material you provide does not violate any of the The Dressupper’s applicable policies and guidelines and that such use does not cause any harm to third parties. Except in cases where any responsibility for the failure to remove illegal content after receiving formal notice to mailto:customercare@thedressupper.comcan be attributed to The Dressupper, you agree to indemnify The Dressupper for all claims against The Dressupper resulting from or otherwise connected with the content and materials you supply.

In some cases users may post personal opinions and comments, which are exclusively the opinions of the author of the comment, and the user posting the comment takes full responsibility for what is written. The Dressupper assumes no responsibility for comments and opinions expressed by users, but reserves the right, in its sole discretion, to remove any comment that, in its sole and absolute discretion, may:

– Instigate hatred or violence;
– injurious to persons, institutions or religions;

In the The Dressupper’s mobile application and website, users can ask and give advice and post comments on the products selected by a user. Specifically, the system provides some preset comments that the users can select; these comments are divided into two categories, called “bad guy” and “good guy”. The category called “bad guy”, in particular, is characterized by an ironic, cynical and confidential tone. By using the The Dressupper’s web site, application and/or services you agree to receive comments like these, that in The Dressupper’s intention, are not offensive, libelous, defamatory, racist, instigating hatred or violence, invasive of privacy, invasive of trademarks, patents or copyrights and property. The Dressupper, therefore, assumes no responsibility for such comments, their use by the users, who will assume full and exclusive responsibility for comments, opinions and advices provided to other users, and expressly release The Dressupper from any liability relating to comments, opinions and advices received from other users.
If you post a comment, the system can automatically detect and record data identifying the computer from which the comment is submitted, including the e-mail address. 11. THE ROLE OF THE DRESSUPPER             
The Dressupper is a platform that allows third party vendors to sell their products online, and offers its users the opportunity to purchase these products online.
The products purchased on Thedressupper.com are owned by third parties and are sold by third parties. As a provider of an e-commerce platform, The Dressupper facilitates transactions that occurs through the site, but is in no way part of the contract of sale of products sold by these third party vendors. The Dressupper does not have possession of the products offered for sale or sold through the platform, does not transfer the ownership of objects from the seller to the buyer, has no role and is not involved in the sale that takes place between sellers and buyers. The purchase agreement is concluded directly between buyers and sellers and The Dressupper, therefore, is not part of it. The Dressupper takes no responsibility and makes no warranty with reference to the purchase agreement, its proper execution and the products covered by this agreement, and does not operate in any way as an agent of the seller. The seller is solely responsible for the sale of products and for any disputes with the buyer. (However The Dressupper provides Customer Support via e-mail to ensure that you have the best experience possible, for complaints or management of returns and orders: customercare@thedressupper.com). The Dressupper has no control, makes no guarantees and takes no responsibility as to the existence, quality, safety and lawfulness of the products advertised or sold, or as the truth or accuracy of the contents of sellers and the users, their posts and feedbacks. The Dressupper cannot guarantee that a seller is actually able to carry out the transaction.

OUR RESPONSIBILITY      
We will do our best to ensure that access to the Dressupper’s services is provided without interruption and that transmissions occur without errors. However, due to the nature of the internet, uninterrupted access and the absence of errors in the transmission cannot be guaranteed. Also, your access to the The Dressupper’s Services may also be occasionally suspended or restricted to allow the accomplishment of repair , maintenance, or the introduction of new activities or services. The Dressupper shall not responsible for (i) losses that are not a result of our breach of these terms and conditions or (ii) any loss of business opportunity (including loss of profits, revenues, contracts, anticipated savings, data, goodwill or costs unnecessarily incurred) or (iii) any other indirect or consequential loss that was not reasonably foreseeable to both you and us, when did you start to use the The Dressupper’s Services.
We will not be responsible for any delay or failure to fulfill the obligations under these terms and conditions if the delay or failure arises from unforeseeable circumstances or force majeure, or, anyway, from causes not attributable to The Dressupper. This provision does not affect your rights under the law and in particular your right to receive the purchased goods within a reasonable time or to be refunded in case of non-delivery due to circumstances arising from unforeseeable circumstances or force majeure. These rights, however, are valid only against the sellers of the products purchased through The Dressupper, which has no part in sale operations or in delivery services, but only offers a virtual showcase for products of third party vendors. The applicable law provisions in some states may prohibit the aforementioned limitations of liability. Where these provisions are applicable, the aforementioned limitations of liability will have no effect and additional rights may be granted. If those rights are related to products purchased on The Dressupper, their sale or delivery, only the owners or sellers of such goods, or the providers of delivery services will take the related responsibilities and The Dressupper will not be affected in any way.
12. LAW AND JURISDICTION        
These General Terms of Use are governed and shall be construed in accordance with the Italian laws and the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. You agree, and we agree in our turn, that this agreement will be subject to the Italian law and jurisdiction and, specifically, to the jurisdiction of the Court responsible for the location where The Dressupper has its registered office, without prejudice to any rights of the consumers to appeal to the Court of their place of residence. As a consumer you can appeal to the Italian Court or to the Court of the EU member State in which you are resident or domiciled for initiating a dispute in reference to these General Terms of Service.
Users who access this website agree that all matters relating to the usage of the website Thedressupper.com are governed by and under the Italian laws. The Dressupper does not guarantee in any way that the content of the site is compliant with regulatory requirements applicable in other countries. Access to the site Thedressupper.com from places where its contents are illegal is expressly prohibited. Users who choose to access this site from these countries are fully aware of the legal consequences and sanctions in which they might incur and will be solely responsible for compliance with local laws.
In the event of a dispute between you and The Dressupper, we strongly recommend you to contact us directly to find a solution by contacting Customer Support. The Dressupper will take into consideration reasonable requests to resolve the dispute through other procedures, such as mediation and arbitration, as an alternative to the Court.
13. MODIFICATIONS TO SERVICE OR CHANGES IN CONDITIONS

You will be subject to the General Terms of Use, policies and terms applicable from time to time when using the The Dressupper’s Services.
If any part of these conditions be deemed invalid, void or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
14. WAIVER        
In case of a breach of these Terms of Use, the waiver of our right to act against you shall not be a waiver of our right to act against you for the breach of other obligations assumed by you.

Furthermore, by sending a notification form, you grant The Dressupper the right to use, reproduce, modify, adapt, publish, translate , create derivative works from, distribute and display the content of such notification throughout the world in any media. This includes the right to send the notification form to the persons involved in the preparation of the content deemed illegal. You agree to indemnify The Dressupper for all third party actions against The Dressupper arising from or related to the sending of a notification form.

ADDITIONAL TERMS FOR THE THE DRESSUPPER’S SOFTWARE

  • Use of the The Dressupper’s Software. You can use the The Dressupper’s Software , and in particular the The Dressupper App, solely for purposes of enabling you to use and enjoy the The Dressupper Services as provided by The Dressupper and as permitted by the General Terms of Use, the Additional Terms for the The Dressupper’s software, as well as the General Terms the Service. You may not incorporate any portion of the The Dressupper’s into your own programs or compile any portion of it in combination with your own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the The Dressupper’s Software or otherwise assign any rights to the The Dressupper’s Software in whole or in part. You may not use the The Dressupper’s Software for any illegal purpose. We may cease providing any The Dressupper’s Software and we may terminate your right to use any The Dressupper’s Software at any time. Your rights to use the The Dressupper’s Software will automatically terminate without notice from us if you fail to comply with any of these Terms or any other Service terms. Additional third party terms contained within or distributed with certain The Dressupper’s Software that are specifically identified in related documentation may apply to that The Dressupper’s Software (or software incorporated with the The Dressupper’s Software) and will govern the use of such software in the event of a conflict with these Terms. The software used in the The Dressupper’s Services is the property of The Dressupper or its software suppliers and protected by Italian and international copyright laws.
  • Use of third-party services. When you use the The Dressupper’s Software , you may also be using the services provided by third parties, such as wireless carriers or a mobile platform providers. Your use of these third party services may be subject to the separate policies, terms of use, and fees of these third parties.
  • No reverse engineering. You may not, and you will not encourage, assist or authorize any other person to copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with, the The Dressupper’s Software, whether in whole or in part, or create any derivative works from or of the The Dressupper’s Software.
  • Updates. In order to keep updated the The Dressupper’s Software, up-to-date, we may offer automatic or manual updates at any time and without notice to you.

If you want to buy one or more of the products shown on the site, you can select them and add them to your shopping cart. Once you have selected all the items you want to purchase, you can close your shopping cart and submit the order. You will see a summary of the products you selected, with their options and their price. You will be asked to choose your payment method.
You will be asked to click on the button to send us confirmation of your purchase order.
Your order will then be considered as a purchase offer submitted through The Dressupper to the Seller of each product for the listed products, each of them considered individually.
Upon receipt of your order, you will automatically receive an e-mail confirming that your order is being processed (“Confirmation order e-mail”), which, however, does not constitute an acceptance of your purchase offer. By sending a Confirmation order e-mail, The Dressupper only confirms that it has received your order and forwarded it to the sellers for verification of data and availability of the products you requested. The purchase agreement will be entered into separately with each vendor for each product only after your payment has been verified and each seller has sent a separate e-mail of acceptance of your purchase offer, which will also include information related to the shipment of the products and the expected date of delivery (“Sale confirmation e-mail”).
The order may be canceled or refused by The Dressupper in case no confirmation of payment is obtained.
If your order includes products sold by multiple vendors, you may receive separated Sale confirmation e-mails. You can cancel your order before receiving our Sale confirmation e-mail, provided that the order has not been prepared for the shipping process. In this case you will not be charged any fees. This, however, is subject to the right of cancellation based on the terms and conditions set out in section 2 hereinafter.
The Dressupper can ask the subject who shall make the payment (bank, lending institution, credit/debit card issuer, Paypal, etc.) to verify the transaction, also contacting it directly. This verification may cause delays in the order confirmation.
All orders placed on the site must correspond to normal consumer needs. This requirement applies both to the number of products purchased with a single order and a plurality of orders relating to the same product, even if each order comprises a quantity of goods corresponding to the normal consumption requirements.
Invoices for products purchased through The Dressupper will be issued and sent by third-party vendors to the purchasers, who agree to receive them in electronic format.
2. RIGHT OF CANCELLATION, EXCEPTIONS AND RETURN POLICIES                 
The Dressupper offers third party vendors the opportunity to showcase and sell their products through the site Thedressupper.com. On every page of products available for sale on the site Thedressupper.com , these products are exclusively owned by third party vendors and are exclusively sold by third party vendors and not by The Dressupper. As a provider of an e-commerce platform, The Dressupper facilitates transactions that occurs through the site, but is in no way part of the contract of sale of goods sold by these third party vendors. The Dressupper has no role and is not involved in the sale that takes place between sellers and buyers. The Dressupper takes no responsibility and makes no warranty with reference to the purchase agreement and its proper execution and does not operate in any way as an agent or representative of the seller.

The Dressupper, while not being a party of the product purchase agreement, which is solely entered into by and between the seller and the buyer, exclusively in order to facilitate the exercise of the right of cancellation by the customer, will contact the seller and will act as liaison between the seller and the buyer.
Subject to the exceptions listed below, you have the right to cancel your order, without giving any explanation, within 14 days from the day you received the products or the conclusion of the contract. If a trusted person received the products on your behalf, your right of cancellation starts from the date of delivery to the person designated by you, other than the courier.

Effects of exercising the right of cancellation      
We will refund all payments received in relation to the products for which you have exercised the right of withdrawal within 14 days from the day we received the communication concerning the exercise of the right of cancellation. We will credit the refund using the same payment method you used to place your order, unless you specify otherwise. In any case, you won’t be charged any fees as a consequence of such refund. We may withhold the refund until we receive the products, or until you provide evidence of the fact that the products have been returned to the supplier, whichever situation occurs first. Remember that you are required to return the products as per our Customer service instructions within 14 days from the day you notify your cancellation. Refunds made according to instructions provided by The Dressupper will be free of charge.
If the products are sent back using a different mode, all the relative costs will be borne by the customer. All costs not attributable to the seller or The Dressupper, such as, but not limited to, the costs for the storage of the package resulting from the failure to receive it or from the unavailability of the recipient, and all customs charges will be, in any case, at your expense.
The integrity of the products to be returned is an essential condition for the exercise of the right of cancellation; you may be held responsible for the diminished value of the products resulting from their handling (other than what is reasonably necessary to verify the nature, features and functioning of the products).
Exceptions to the right of cancellation  
The right of cancellation does not apply in the case of:
– Supply of sealed goods which are not suitable to be returned for hygienic reasons or for reasons related to health protection, and which have been opened after delivery, or supply of products which are, after delivery, inseparably mixed with other items;
– Supply of tailored or clearly customized products;
– Service agreements, after the service has been fully provided by The Dressupper, if you have expressly agreed to the provision of the service waiving your right of cancellation after the full execution of the contract.
Returns
To request authorization to return products, you must send a notice to The Dressupper to the e-mail address: mailto:customercare@thedressupper.com. We will send you a receipt confirmation by e-mail.
You will be required to list the items you wish to return, specifying the reason for the return, and indicate the type of compensation you require. The Dressupper will send you then a confirmation e-mail containing the Return Authorization Number (RAN) and the instructions to follow to return the products.
The procedure for returning the products will be specified in the e-mail sent by The Dressupper. The return authorization number must be written on the waybill, which must be completed as specified in the e-mail received.
Refunds made according to instructions provided by The Dressupper will be free of charge.
If the returned products are sent back using a different procedure, all costs will be borne by the customer. All Clients agree to accept the shipping of the package containing the returned products. If the package is not delivered for reasons attributable to the customer (wrong address, unavailability of the recipient, wrong telephone number, etc.), or if the customer does not accept the shipping, shipping costs and any customs fees will be charged to the customer or deducted from the refund. All costs not attributable to the seller or The Dressupper, such as, but not limited to, the costs for the storage of the package resulting from the failure to receive it or from the unavailability of the recipient, and all customs charges will be, in any case, at your expense.
There are 2 types of compensation:
Size exchange is possible to exchange only for a different size or a different color of the same item, if available. The new product can be returned following the same procedure.
Refunds will be made as soon as the returned products are received and verified. The time of the refund may vary according to payment method and credit card you used.
For orders paid using Paypal or bank transfer the amount will be returned to the original account. The refund will be issued in the same currency as the original purchase. Any differences in the amount due to the fluctuation of the exchange rate will not be refunded.
Shipping of the returned products must be made within 14 days from the confirmation e-mail sent by The Dressupper.
Returns must be made under the following conditions:
– Labels, tags or safety devices on the products that are returned must not be cut or broken. Products must not have been worn, washed or altered and must not show any signs of use. The soles of the shoes must be in perfect condition and show no signs of any kind.
– Each item must be returned with all labels, packaging and accessories (dustbags, hangers, garment covers etc.) received with the order.
– All footwear and accessories must be returned with their original box, which is considered in all respects an integral part of the product itself, and which must not have been damaged and/or altered in any way, nor used as a single outer packaging.
– Returns must be shipped in the original shipping box or in a box of the same size or smaller.
– Swimwear and intimate products (bikinis, underwear, etc.) must be tried on over your own underwear. The returns of these items will be rejected and the products will be returned to the customer if the protective hygienic label has been removed, or if the products show signs of use.
– Returns must be shipped from the same country which the original order was delivered to.
The Dressupper reserves the right not to accept returns sent in ways other than those mentioned in the e-mail containing instructions for returning the products if the delivery results in additional costs or requires pick-up at the courier’s office.
The Dressupper reserves the right to request photographic evidence before authorizing returns for defective products and bear the shipping costs for their return.
The Dressupper also reserves the right to refuse unauthorized returns or returns which do not comply with all required conditions.
In these cases, the products will be returned to the sender at the original shipping address.
Any acceptance of such returns, however, involves a charge equal to 10% of the value of the returned products.
For all matters not specifically agreed herein, the laws for remote selling applicable from time to time to the seller will apply.
3. PRICES AND AVAILABILITY      
All prices include VAT as applicable by law.
